Won a Tender in Uzbekistan — What Next? 7 Places Winners Lose Money

Won a tender — what next? Winning is not yet money: ahead lie the contract, registration, the advance and acceptance, and every step has its own deadline. In construction tenders on the Ministry of Construction platform, you get 1 business day to confirm the contract. Miss it and you are deemed to have refused, and you are barred from construction tenders for 24 months. According to Tanlo data as of 27 October 2026, half of all contracts are confirmed within 2.2 calendar days of the winner being selected, and 90% within 4.2 days.

Below: how a public procurement contract is concluded under each procedure, what advance is actually paid, and 7 places where winners lose money.

The golden rule: if you are not sure you can handle the volume, the deadline or the price, do not bid. Once you have won, walking away without losses is almost impossible.

Won a tender — what next: contract deadlines

There is no paper contract: the system generates it from a standard template, and the parties sign it in their online accounts with an electronic digital signature (EDS) (Regulation approved by Cabinet of Ministers Resolution No. 276, paras. 9, 21).

Procurement procedureWhat happens after you winDeadline
E-shopThe system registers the deal. If there is only one offer, the buyer may request a price reduction: you have 1 business day to reply, and if you refuse, the buyer may run the purchase againThe deal is registered if the buyer has not sent a price request within 1 business day
AuctionThe system determines the winner and generates the contract automaticallyImmediately after bidding closes
Selection of best offersThe protocol is open to participants' objections for 2 business daysContract no later than 10 business days after the winner is determined

The Ministry of Construction platform is mandatory for contracts of state buyers worth more than 6,000 base calculation amounts (BRV, the statutory unit used for fees and thresholds) — 2,640,000,000 soums at a BRV of 440,000 soums. For cheaper contracts, the rules of Resolution No. 46 are only recommendations (Regulation approved by Resolution No. 46, para. 3).

Tanlo data: how fast construction tenders are signed

Since 1 January 2026, 32,103 Ministry of Construction tenders have reached a final outcome. 22,248 ended in a contract, 8,886 (28%) failed, 643 went to a repeat tender and 326 were cancelled.

2.2 daysto confirm half of all contracts
4.2 daysto confirm 90% of contracts
5%price cut made by half of the winners
30 daysworks period in half of the contracts

Calendar days. Half of the winners cut the price by exactly 5%, because until 23 October 2026 the platform did not accept prices below 95% of the starting price (Regulation approved by Resolution No. 46, para. 10(d)). Cabinet of Ministers Resolution No. 583 of 21.10.2026 lowered the floor to 90%, so you can now cut the price by up to 10%. But in construction, experience and rating also decide who wins — see "Construction tenders in Uzbekistan: why price doesn't decide who wins".

Refusing the contract after winning: what you lose

When the contract takes effect

Budget contracts (including those of earmarked and off-budget funds of budget organisations) take effect only after Treasury registration — registration of the contract with the Treasury of the Ministry of Finance (Law "On the Contractual and Legal Framework for the Activities of Business Entities", Art. 13). In electronic public procurement, the Ministry of Finance registers a budget buyer's contract automatically within 1 business day (Resolution No. 276, para. 23). No payments are made under contracts that are not in the Unified Register of Contracts (ZRU-684, Art. 47).

Until the contract is registered, do not buy materials or put people on site.

Advance payments under public contracts: how much is actually paid

E-shop and auction — no advance, the money is blocked in advance

On behalf of a budget buyer, the Ministry of Finance transfers the full contract amount to the exchange's settlement and clearing house (RKP), and you are paid from it after delivery. A corporate buyer (a state-owned enterprise) transfers the amount to the RKP within 10 business days after the contract is registered; otherwise, within 1 business day its deposit is transferred to the supplier (Resolution No. 276, paras. 23–25).

Selection and tender — read the draft contract

A budget buyer pays without the RKP, and the prepayment is set in the contract (Resolution No. 276, para. 23). For budget organisations, Cabinet of Ministers Resolution No. 241 lists goods for which the advance may exceed 15% (electricity, fuel and lubricants, tickets, telecom services, etc.) and requires a 30% prepayment in contracts of up to 1,000,000,000 soums — except for goods on that list (para. 1¹). In practice this is not always followed, so plan according to the draft contract.

Construction — the standard 15% + 15% schedule

The standard schedule: a first advance of 15%, a second of 15%, ongoing financing of 60%, and 5% after the warranty period (Regulation approved by Resolution No. 46, Annex 4). These 5% are paid after a 12-month warranty, provided the operating organisation has raised no justified objections (Resolution No. 46, para. 6). The contract is the basis for the advance (Regulation, para. 10(z)), but the payment date depends on how the project is funded.

What the contracts actually say. Of 21,274 construction tender contracts in 2026 with the advance field filled in: 15% in 12,346 (58%), 30% in 7,067 (33%), more than 30% in 648 (3%), and no advance in 74. Whether 30% is a single advance or two of 15% cannot be seen from the data. In large contracts, 30% is more common:

Contract valueContracts15% advance30% advance
Up to 1,000,000,000 soums14,0599,256 (66%)4,192 (30%)
1–5 billion soums6,0102,853 (47%)2,287 (38%)
Over 5 billion soums1,205237 (20%)588 (49%)

Example: a 500,000,000-soum contract with a 15% advance means 75,000,000 soums. Everything else until the next payment comes out of your own pocket. Calculate your working capital before you bid — see "A UZS 100 m tender: how much cash you really need to bid".

7 places where winners lose money

  1. Shipping too early. In the e-shop and at auctions, the basis for delivery is the RKP's notice that the money has arrived. Ship before that and the risk of non-payment is yours (Resolution No. 276, paras. 26–27).
  2. No acceptance in the system. If, 3 business days after the delivery deadline, there is no delivery data in the system, the RKP blocks the budget buyer's money until a decision by a court or the Complaints Commission (Resolution No. 276, paras. 33–34).
  3. Late-delivery penalty. 0.5% of the unperformed part per day, but no more than 50% of its value, plus damages (Law on the Contractual and Legal Framework, Art. 25). On a 150,000,000-soum contract, a 10-day delay costs 7,500,000 soums, or 5% of the contract.
  4. Wrong quality. The buyer may refuse to accept and pay, and recover a fine of 20% of the value of the non-conforming goods or works (ibid., Art. 26).
  5. Poor performance also means the register. Companies found guilty of non-performance or improper performance of a contract are also added to the register, except in cases of force majeure (ZRU-684, Art. 48).
  6. A pricing mistake. A supplementary agreement may not change the goods, their quality or range, increase the quantity or price, or extend the delivery period, except in cases provided by law (ZRU-684, Art. 34). In construction, price and timeline are not adjusted in the first financial year (Resolution No. 46, para. 2).
  7. Unbudgeted costs. In a construction tender, the organiser's fee — 0.1% of the starting price, but no more than 20 BRV (8,800,000 soums) — is deducted from the winner's bid security (Regulation approved by Resolution No. 46, para. 25). And the winner must perform at least 60% of the works itself (Resolution No. 46, para. 2) — you cannot subcontract everything.

If the buyer delays payment, the penalty is 0.4% of the overdue amount per day, but no more than 50% (Law on the Contractual and Legal Framework, Art. 32). Both penalties apply unless the law or the contract provides otherwise (Art. 24). Disputes go to the Complaints Commission — see "Appealing tender results in Uzbekistan: free, decided in 7 working days".

Performance security: how much money stays blocked

In the e-shop and at auctions, the 3% deposit stays blocked until delivery is complete (Resolution No. 276, paras. 13–14, 31). In a selection and a tender, the buyer may require a deposit (up to 3% and up to 5% respectively) or a bank guarantee until the contract is fully performed, if the tender documents say so (ZRU-684, Art. 19, 63; Resolution No. 276, para. 15). Otherwise the deposit is released within 1 business day after the contract is concluded (para. 32). More details in "Bid deposits in Uzbekistan tenders: how much is frozen and when".

Checklist: your first week after winning

  1. In a construction tender, check your account on the day bidding closes and on the next business day: you have 1 business day to confirm the acceptance.
  2. Make sure in advance that your EDS is valid.
  3. Check the contract against the lot: amount, deadline, advance, place of delivery.
  4. Sign the contract on time and check that it has been registered.
  5. In the e-shop and at auctions, do not ship until you receive the RKP notice.
  6. Collect acceptance documents straight away: without them you will not be paid.

How we calculated

Tanlo export from the Ministry of Construction tender database (tender.mc.uz) as of 27.10.2026: tenders published since 01.01.2026 with a final status. Time to contract is measured from the date the winner was determined to the date the contract was confirmed. The advance is its share of the contract value (where both fields are filled in); for projects lasting more than a year the share is approximate, since the schedule calculates the advance from the first year's works. Two thirds of the contracts are below 1 billion soums — under the threshold at which Resolution No. 46 becomes mandatory — so this reflects the platform's practice.

Resolution No. 46 is cited as amended on 21.07.2026, with the changes made by Resolution No. 583 of 21.10.2026 (in force since 23.10.2026): the price floor was lowered from 95% to 90%, while the acceptance deadlines, the 24-month ban and the advance schedule were unchanged. As of 27.10.2026, the consolidated text on lex.uz has not been updated — check which version you are reading.

In the Tanlo catalogue, Ministry of Construction tenders are listed together with lots from other platforms, and Telegram alerts arrive on the day of publication.

FAQ

Won a tender — what next?

Watch your account and sign the contract with your electronic digital signature (EDS) on time: in a selection of best offers and a tender, no later than 10 business days after the winner is determined; in a Ministry of Construction tender, confirm the acceptance within 1 business day. Then make sure the contract has been registered, and only after that start delivery or works.

How many days do you have to conclude a public procurement contract?

In the e-shop and at auctions, the system registers the deal. In a selection of best offers and a tender, the contract is concluded no later than 10 business days after the winner is determined (Regulation approved by Cabinet of Ministers Resolution No. 276, paras. 103, 161). On the Ministry of Construction platform you have 1 business day to confirm the acceptance, and 1 business day after that the contract is deemed signed (Regulation approved by Resolution No. 46, paras. 40, 41). According to Tanlo data, half of construction contracts are confirmed within 2.2 calendar days, and 90% within 4.2 days.

What happens if you refuse the contract after winning?

In the e-shop and at auctions, the contract is offered to the next participant, and the refusing bidder's deposit stays blocked until a court or the Public Procurement Complaints Commission decides its fate. In a selection or tender, the deposit is not returned and the contract passes to the reserve winner. A company that refuses is added to the Register of Unscrupulous Contractors for 2 years. In a Ministry of Construction tender, in addition, the bid security is not returned and the company is barred from electronic construction tenders for 24 months.

What advance is paid under a public contract in Uzbekistan?

In construction, the standard schedule under Resolution No. 46 is a first advance of 15% and a second of 15%. According to Tanlo data as of 27.10.2026, a 15% advance appears in 58% of 2026 construction tender contracts and 30% in 33%. Resolution No. 241 requires budget organisations to prepay 30% in contracts of up to 1,000,000,000 soums (except for goods on its list), but in practice this is not always followed — rely on the draft contract. In the e-shop and at auctions there is no advance: the contract amount is transferred in advance to the exchange's settlement and clearing house (RKP).

What is the penalty for delay under a public contract?

Under the Law "On the Contractual and Legal Framework for the Activities of Business Entities", the supplier pays 0.5% of the unperformed part per day of delay, but no more than 50% of its value, plus damages (Art. 25). The buyer pays 0.4% per day for late payment, also capped at 50% (Art. 32). If the law or the contract provides otherwise, that rule applies (Art. 24).
